Brownhill Investment Company Limited, the event’s planners, are pursuing legal action to obtain 2 billion naira in general damages from Davido, citing a contract breach due to his no-show at the 2023 Warri Again festival.

Furthermore, the plaintiff is seeking N150 million for legal and professional costs, along with an additional N30 million for the expenses incurred in filing the lawsuit.

Davido’s legal representative, Mr. Norrison Quakers, SAN, sought a pause in the proceedings, arguing for a delay in the lawsuit given its current review by the Court of Appeal, a higher judicial authority.

However, the court, through a direct verdict, stated that proceedings would continue unless a directive to pause further actions comes from the Court of Appeal, thus rejecting the stay application.

Additionally, the court approved a motion that permits the claimant to amend their response to Davido’s defense and ordered that Pre-Trial Conference (PTC) documentation be completed within two weeks as per court regulations. The case is now set to proceed to a pre-trial conference on March 21, 2024.

Efforts by Davido’s legal team to dismiss the case, citing improper jurisdiction and arguing it should be filed in Effurun, were previously overruled by the court.

Amaju Pinnick, representing Brownhill Investment Company Limited, disclosed to the festival attendees that Davido breached his performance contract despite receiving a significant upfront payment and arrangements for a private jet to transport him to Warri.

In response, Davido took to social media, explaining that a scheduling conflict with a concert in New Zealand was the reason for his absence. He argued that the organizers of Warri Again were informed of this conflict but chose to proceed with using his image for promotional purposes.
