DMCA Policy

TalkGlitz respects intellectual property rights and complies with the Digital Millennium Copyright Act.

1. Overview

TalkGlitz Media ("TalkGlitz", "we", "us", "our") respects the intellectual property rights of others and expects users of our platform to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), we will respond promptly to claims of copyright infringement that are reported to our designated copyright agent.

If you are a copyright owner, or are authorised to act on behalf of a copyright owner, and believe that content on talkglitz.media infringes upon your copyright, you may submit a notification pursuant to the DMCA by providing our copyright agent with the information listed below.

Upon receipt of a valid notification, we will take appropriate action, which may include removing or disabling access to the allegedly infringing material and notifying the content provider.

2. Filing a DMCA Notice

To file a DMCA takedown notice, please provide our copyright agent with a written communication that includes all of the following:

  1. A physical or electronic signature of a person authorised to act on behalf of the owner of an exclusive right that is allegedly infringed.
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity, and that is to be removed or access to which is to be disabled, with information reasonably sufficient to permit TalkGlitz to locate the material (e.g., the full URL).
  4. Your contact information, including address, telephone number and, if available, an email address.
  5. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorised to act on behalf of the owner of an exclusive right that is allegedly infringed.

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability. If you are unsure whether material on our site infringes your copyright, consider consulting a lawyer before sending a notice.

3. Counter-Notification

If you believe that material you posted on talkglitz.media was removed or disabled by mistake or misidentification, you may file a counter-notification with our copyright agent. A counter-notification must include:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled.
  3. A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which TalkGlitz may be found, and that you will accept service of process from the person who provided notification or an agent of such person.

Upon receipt of a valid counter-notification, we will promptly provide a copy to the person who filed the original DMCA notice, and we will restore the removed material in 10–14 business days following receipt unless our designated agent receives notice that the original complainant has filed a court action seeking to restrain the allegedly infringing activity.

4. Repeat Infringers

TalkGlitz has adopted a policy of terminating, in appropriate circumstances, the accounts of users who are deemed to be repeat copyright infringers. TalkGlitz may also, at its sole discretion, limit access to our platform and/or terminate the accounts of any users who infringe the intellectual property rights of others, whether or not there is any repeat infringement.
