Two businessmen, Moses Pam Dalyop and Abdulmumuni Yakubu, have filed a lawsuit against the Inspector General of Police (IGP), DSP Olatunji Disu (the officer in charge of the Police Intelligent Response Team (IRT)), Chuangyue Industrial NIG. Ltd, and Chen Taohong for alleged unlawful detention and incarceration beyond the constitutional limit. The lawsuit seeks compensation of N10 million and an order declaring the detention illegal and unconstitutional, as well as an order of perpetual conjunction restraining the respondents from further arresting, torturing, humiliating, harassing, threatening, and detaining the applicants in connection with the case.
In support of the originating motion, Mr Daniel Henry Akogwu claimed to have the consent of the applicants under detention with the defendant. He explained that the first applicant, Moses Pam Dalyop, is an architect and contractor who he contracted to carry out construction work, while the second applicant, Abdulmumuni Yakubu, is a businessman who supplies tyres for his company. Akogwu further stated that the 4th and 5th defendants are business partners who engaged the men of the Police Intelligence Response Team (IRT) to arrest and detain the applicants.
Akogwu added that his company, Elispe Industries Limited, entered into a joint venture agreement with the 4th and 5th respondents, where he signed as the Managing Director of Elispe Industries Limited, and the 5th respondent and Mao Jengzing signed as Directors of the 4th respondent. He explained that the joint venture agreement was executed between Elispe Industries Limited and the 4th and 5th respondents, and vital documents of the transaction were left in the possession of the 4th respondent. When he asked about the documents, the 5th respondent withheld them, admitting that they were in their possession and promising to hand them over on a specific date but failing to do so.
Akogwu also stated that there was a misunderstanding between Elispe and Mao Jengzing, and the arrest of the two applicants, who were carrying out their lawful duties in the premises of Elispe Industries Limited, resulted from this misunderstanding. When he inquired about their arrest at the A Division Police Station, he was informed that it was based on a petition by the 4th and 5th respondents, and the applicants have been in detention since then.
