The Supreme Court ruled in favour of the All Progressives Congress (APC) candidate for Yobe North Senatorial District, Ahmad Lawan, in a three-to-two split decision on Monday.
The nomination was affirmed for the upcoming February 25th general election. The lead judge, Justice Centus Nweze, determined that Lawan’s main competitor, Bashir Machina, did not have grounds to file a suit against the APC for fraudulently transmitting Lawan’s name to the Independent National Electoral Commission.
The previous decisions made by the Federal High Court in Yobe and the Court of Appeal in Abuja, which recognized Machina as the APC candidate, were deemed to be incorrect and overturned.
However, in a dissenting opinion, Justice Adamu Jauro criticized the APC primary held on June 9, 2022, in which Lawan was selected as the party’s candidate. Jauro dismissed the APC’s appeal and imposed a cost of N3m in favor of Machina and against the party.
