The Action Peoples Party (APP) has withdrawn its petition against the declaration of Bola Tinubu as the winner of the 2023 Presidential Election.

Presidential Election: APP Withdraws Petition Against Tinubu's Victory  The announcement was made during the resumed proceedings before the Presidential Election Petition Court (PEPC), sitting in Abuja.

 

Mr. Obed Agu, counsel to the APP, told a five-member panel of the court that the withdrawal notice was filed on May 9th and was based on Paragraphs 29(1)(2) and (3) of the Schedule for Election Petitions.

“My Lords, we are seeking an order of this court for leave to withdraw this petition filed on March 19. As well as an order striking out or dismissing the petition, same having been withdrawn,” Agu stated.

On his part Chief Wole Olanipenkun, SAN, counsel to Tinubu, said he was not opposed to APP’s application to withdraw the petition and commended them for their decision. The Independent National Electoral Commission (INEC) equally did not oppose the application.

After listening to all the parties, Justice Haruna Tsammani-led panel dismissed the petition.,.

“Having listened to all the parties, we are satisfied that there is no collusion. The petition having been withdrawn, it is hereby dismissed,” the court held.

The APP had alleged that the results of the presidential election were manipulated to favor Tinubu in 11 states of the federation. It claimed that the President-elect had “corruptly induced” electoral officers to falsify results at local government and state collation centers in Rivers and 10 other states.

It is worth noting that another political party, the Action Alliance (AA), also withdrew its petition on Monday. Both parties failed to adduce any reason behind their sudden decisions to terminate further proceedings on the case they brought against Tinubu’s election victory.
